Hardscape Installation – 5-Year Structural Warranty
(Residential Applications Only)
Elegant Estates provides a Five-Year Structural Installation Warranty on qualifying hardscape installations, including interlocking concrete pavement systems and reinforced retaining wall systems installed in accordance with industry best practices.
This warranty reflects our commitment to craftsmanship, proper base preparation, and installation standards consistent with CMHA (Concrete Masonry & Hardscapes Association) guidelines.
Warranty Term
This warranty is valid for five (5) years from the date of substantial completion of the installation and applies to residential projects only.
The warranty is non-transferable unless otherwise stated in writing.
What This Warranty Covers
This is a structural installation warranty only. It covers defects in workmanship related to the installation of:
- Interlocking concrete paver systems
- Reinforced segmental retaining wall systems
- Associated structural base preparation performed by Elegant Estates
Specifically, this warranty covers:
- Surface settling directly attributable to improper compaction performed during installation
- Structural failure resulting from installation error
- Movement or instability caused by improper base construction
- Retaining wall structural instability due to installation deviation from engineered or CMHA standards
If a covered structural defect occurs within the warranty period, Elegant Estates will repair the affected area at no cost to the homeowner.
Conditions for Warranty Validity
This warranty is valid only when:
- Installation is performed in accordance with CMHA guidelines and accepted industry standards
- The installed system is used as designed (vehicular systems for vehicles; pedestrian systems for pedestrian traffic)
- No homeowner-directed deviation from structural recommendations was requested
- No site-condition-forced deviation occurred outside of written engineering guidance
Any deviation from CMHA guidance, whether by homeowner directive or unavoidable site condition, may void the warranty unless documented and agreed upon in writing.
What This Warranty Does NOT Cover
This warranty does not cover:
Environmental or Site Conditions
- Improper or inadequate site drainage
- Hydrostatic pressure or water infiltration issues
- Subsurface instability beyond installed base depth
- Organic material decay beneath the system (stumps, roots, buried debris)
- Subsurface tunneling (animals, pests, void creation)
- Frost heave beyond engineered base design
- Acts of God (flooding, extreme freeze/thaw cycles, seismic activity, etc.)
Use & Abuse
- Vehicular traffic on non-vehicular systems
- Heavy equipment or overload beyond design capacity
- Snow plow damage, metal blade scraping, or improper snow removal practices
- Salt or chemical misuse beyond normal residential application
Material Defects
- Manufacturer defects in pavers, wall units, adhesives, or polymeric sand
- Polymeric sand failure due to manufacturer defect
- Efflorescence (natural mineral migration)
- Normal color variation or fading
Aesthetic Conditions
- Surface staining
- Oil stains, rust stains, fertilizer discoloration
- Moss, algae, or biological growth
- Normal joint sand erosion
- Minor surface shifting that does not affect structural integrity
This warranty applies strictly to structural installation performance, not cosmetic appearance.
Drainage & Subsurface Disclaimer
Elegant Estates designs and installs hardscape systems based on visible and reasonably discoverable site conditions at the time of installation. We are not responsible for unknown subsurface conditions, concealed voids, buried organic matter, prior contractor work, or underground instability not reasonably detectable during excavation.
Settlement caused by subsurface movement beyond the installed base layer is not covered.
Structural vs. Environmental Clarification
This is a craftsmanship warranty — not a performance warranty against environmental or misuse factors.
Elegant Estates guarantees that the system was installed properly according to accepted standards. We cannot guarantee long-term performance if the system is subjected to conditions beyond its intended design or to forces outside of our control.
